1. Accepting these terms
These Terms of Use (“Terms”) govern your use of the Chunks iOS app, website, and related services (together, the “Services”). By using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
If you download Chunks through Apple’s App Store, Apple’s Standard End User License Agreement also applies. These Terms supplement that agreement; the Apple agreement controls if there is a direct conflict.
2. Eligibility
You must be at least 13 years old and old enough to consent to these Terms under the law where you live. If you are not legally able to enter into this agreement, a parent or legal guardian must review and agree to these Terms for you.
3. What Chunks provides
Chunks is a productivity tool that uses your goals, preferences, and reflections to generate small suggested actions, progress summaries, and related guidance. Features may include voice transcription, mission conversations, AI-generated chunks, reflections, progress views, and a lightweight to-do list.
Chunks may change, add, remove, pause, or discontinue features as the product evolves. We aim to give reasonable notice when a material change affects your use, but may act immediately for security, legal, or operational reasons.
4. Accounts and security
You are responsible for activity under your account and for keeping access to your Apple account and device secure. Provide accurate information, do not share account access in a way that compromises security, and notify us promptly if you suspect unauthorized use.
You can delete your Chunks account from inside the app. See the account deletion instructions.
5. Your content
You retain ownership of the missions, reflections, messages, to-do items, recordings, and other content you submit (“Your Content”). You give Chunks a limited, non-exclusive license to host, process, reproduce, transmit, and display Your Content only as needed to operate, secure, and improve the Services and provide features you request.
You are responsible for Your Content and must have the right to submit it. Avoid including information that you do not want processed by AI and cloud service providers. The Privacy Policy explains these data flows.
6. AI-generated content
AI-generated chunks and guidance may be inaccurate, incomplete, repetitive, unsafe, or inappropriate for your circumstances. You decide whether and how to act on a suggestion.
Chunks does not provide medical, mental-health, crisis, legal, financial, employment, or other professional advice. Do not rely on Chunks for emergencies, high-risk decisions, or activities where an incorrect suggestion could cause harm. Contact qualified professionals or local emergency services when appropriate.
Because AI systems can produce similar responses for different users, AI output generated for you may not be unique and may resemble output generated for others.
7. Acceptable use
You may not use the Services to:
- break the law or infringe another person’s rights;
- harass, exploit, threaten, or harm another person;
- upload malware, attempt unauthorized access, disrupt the Services, or bypass usage or security controls;
- reverse engineer or extract source code except where applicable law expressly permits it;
- use automated means to scrape or access the Services without permission;
- misrepresent AI output as professional advice or use it for prohibited, deceptive, or high-risk decisions; or
- help another person do any of the above.
8. Plans and payments
Chunks does not currently offer an active paid plan or App Store subscription. If paid features launch, pricing, billing period, renewal terms, cancellation instructions, and any trial terms will be shown before purchase. App Store purchases will be processed by Apple and subject to Apple’s payment and refund rules. We will update these Terms before paid access launches.
9. Chunks property
The Services—including the Chunks name, branding, mascot, interface, illustrations, software, and content we provide—are owned by Chunks or its licensors and protected by intellectual property laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer ownership of Chunks property to you.
10. Third-party services
Chunks relies on third-party services, including Apple, Supabase, OpenAI, and website infrastructure providers. Their services may be governed by their own terms and may occasionally be unavailable. Chunks is not responsible for third-party products or services beyond what applicable law requires.
11. Suspension and termination
You may stop using Chunks at any time and may delete your account in the app. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if needed to protect the Services or other users. Where reasonable, we will provide notice and an opportunity to address the issue.
Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that Chunks will always be available, error-free, secure, or that any suggestion will produce a particular result.
Some jurisdictions do not allow certain warranty exclusions, so some of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Chunks and its developer, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of the Services.
To the fullest extent permitted by law, our total liability for claims related to the Services will not exceed the greater of the amount you paid Chunks in the twelve months before the event giving rise to the claim or US $50. These limits do not apply where prohibited by law.
14. Governing law and disputes
These Terms are governed by applicable law, without overriding consumer protections that apply where you live. Before filing a formal claim, please contact us so we can try to resolve the issue informally. Nothing in these Terms prevents either party from seeking relief in small claims court or exercising rights that cannot lawfully be waived.
15. Changes to these terms
We may update these Terms as Chunks changes. We will post the revised Terms here, update the effective date, and give additional notice when required. Continuing to use the Services after updated Terms take effect means you accept them; if you do not agree, stop using the Services and delete your account.
16. General terms
If a provision is unenforceable, the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, financing, reorganization, or sale of the Services. These Terms, the Privacy Policy, and any applicable App Store agreement are the entire agreement about the Services.
